ARTICLE 1. Scope of Application of the General Terms and Conditions of Sale



The present general conditions transmitted to the Client form a contractual set and constitute the entirety of the contractual relations between the company Nature et Océan SARL and its Clients. ARTICLE 2. Acceptance of the General Terms and Conditions of Sale

The Client is therefore well informed that by ticking the box "I confirm that I have read the General Terms and Conditions of Sale" when placing the order online or by receiving the confirmation email of the reservation to which these conditions are attached, he/she manifests his/her specific, free, and informed consent, particularly regarding the use of personal data. This unconditional acceptance is valid whether it is for the Client or for any person participating in the stay. These General Terms and Conditions of Sale are also available on the Nature et Océan website and at the Nature et Océan Reception.

ARTICLE 3. Reservation



3.1 Reservation Conditions
Reservation Method - The Client has the option to make a reservation online, by telephone, or on-site.

Validation of the Reservation - Any reservation request is considered a definitive reservation from the moment it is accepted by Nature et Océan. The latter has full freedom to refuse it based on availability or any circumstances that may harm the intended stay. The acceptance of the reservation is exclusively materialized by sending a reservation confirmation by email, mail, or by hand delivery.

Any reservation, to be validated, must also be accompanied by a payment including:

  • An advance payment of 30% to 100% of the total amount of the stay depending on the reservation date;
  • Any subscription fees for cancellation/interruption insurance.


Electronic signature applicable to online sales - The online provision of the client's credit card number and the final validation of the order will constitute proof of the client's agreement for the amounts due for the reservation and express signature and acceptance of all operations carried out.

Capacity and participants in the stay - The reservation is nominative. The Client must be over 18 years old, participate in the reserved stay, and legally provide the names, first names, and dates of birth of all participants, including minors and newborns. Nature et Océan reserves the right to refuse any person not registered at the time of booking. Any incorrect information is likely to result in the cancellation of the stay. Due to the nominative nature of the reservation, it cannot be transferred or subleased in whole or in part. For security and insurance reasons, the maximum number of occupants per type of accommodation, as described in the brochure and on the website, must be strictly respected. Nature et Océan will refuse any person beyond this capacity (including newborns).

3.2 Important Information
Welcoming Minors - For obvious safety reasons (swimming pool, evacuation of the village in case of alert, etc.) and health (hospitalization, etc.), minors not accompanied by their legal guardians, as defined in Article 389 of the Civil Code, are not admitted. Furthermore, Nature et Océan is not authorized, as defined by Decree 2002-883 of May 3, 2002, to provide collective or individual stays outside the family home for minors under 18 years of age, not accompanied by one of their legal guardians. As for minors accompanied by their legal guardians, they are under the sole responsibility of the latter and must not be left unsupervised on the village premises.

Non-contractual nature of communication materials - Any document other than these General Terms and Conditions of Sale, and in particular, catalogs, brochures, advertisements, notices, have only an informative and indicative value, non-contractual. The plans and photos of the rental accommodations are given for illustrative purposes. The layout and characteristics of the rooms may vary from one model to another.

Nature and Océan facilities and activities - It may happen that certain activities and facilities offered by Nature and Océan (directly or through providers) such as wifi or elements of the water park, as listed in the description, are removed, especially for climatic reasons or in case of force majeure, or do not function, especially in the early and late seasons. Nature and Océan's liability cannot be engaged. Nature and Océan will inform the Client of any work/unforeseen events/arrangements undertaken during the stay.

ARTICLE 4. Prices



The applicable prices are those indicated at the time of booking by telephone, online, or on-site. They are subject to change during the season and are in euros, including VAT. Any subsequent modification of the applicable VAT rate, occurring between the time the rates were determined and the billing of the stay, will result in a proportional modification of the total price including VAT, which the Client accepts without reservation.

The price includes:

  • The rental of the pitch or rental accommodation equipped as defined in the brochure and websites;
  • Consumption of water, gas, and electricity;
  • Access to the village, its equipment/facilities (except those listed below) as defined in the brochure and websites;
  • Parking space for one car per rental (the space is not necessarily adjacent to the rented space).

The price does not include:

  • Various taxes;
  • Paid activities offered by the Village to be paid on-site;
  • Supplements such as cleaning fees;
  • Security deposits (security deposit);
  • The guarantee of specific accommodation;
  • Cancellation/interruption insurance;
  • Optional equipment.

ARTICLE 5. Terms and Modes of Payment



5.1 Payment Terms

The full price of the stay is due:

  • 30 days before the start of the stay;
  • Or immediately for any reservation made less than 30 days before the start of the stay.

In the event of non-payment on the agreed date, Nature and Océan is entitled to consider that the Client has canceled his/her reservation and retains any sums already paid.

5.2 Payment Methods
The payment methods for the deposit and/or the total stay accepted by Nature and Océan vary depending on the date of payment:

  • If payment is made at least 30 days before the arrival date: it can be made by credit card, bank transfer, holiday vouchers (sent by registered mail with acknowledgment of receipt), or connected holiday vouchers, and by check in euros (sent by registered mail with acknowledgment of receipt).
  • If payment is made between 29 and 15 days before the arrival date: it can be made by credit card, bank transfer, or connected holiday vouchers.
  • If payment is made between 14 days and the day before arrival: it can be made by credit card or bank transfer.
  • For on-site payment: the client can pay the balance by credit card, cash, or holiday vouchers. Checks are not accepted.

The security deposit and the tourist tax must be paid on-site upon arrival, by credit card or in cash.

5.3 Clarification on Credit Card Payments
Accepted credit cards are those from the Carte Bleue networks (Visa, Eurocard/Mastercard). American Express is not accepted.
The transaction is immediately debited from the client's credit card after verification of its data. In accordance with Article L.132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By providing information regarding their credit card, whether online or by phone, the client authorizes Nature et Océan to debit their credit card for the amount of the deposit or the total stay. To this end, the client confirms that they are the holder of the credit card to be debited and that the name on their credit card is indeed theirs. ARTICLE 6. Services Not Included in the Price



6.1. Tourist Tax

The tourist tax is collected on behalf of the municipality and is payable. Its amount, determined per person per day, may be subject to change during the year.

6.2. Paid Services Offered by Nature et Océan to be Paid On-Site

Certain services offered by Nature et Océan are optional and require payment. For example, bike rentals and access to the laundry facilities are among these paid services.

6.3. Cleaning Fees

The client can request that the departure cleaning be performed by Nature et Océan for a cleaning fee, the amount of which varies depending on the type of accommodation and the length of stay. The cleaning fee does not include dishwashing and kitchen utensil cleaning, and trash must be disposed of.

6.4. Security Deposit

For any stay within Nature et Océan, a security deposit of €300 for accommodations such as cottages or cabins and €2000 for the Villa Coloniale will be requested no later than the day of arrival at the Village. Payment can be made by credit card or check. This deposit will be refunded in full on the day of departure or no later than fifteen days afterward, following a satisfactory cleaning inspection and equipment assessment. Otherwise, the security deposit will be deducted in full. Damages exceeding the amount deposited as a security deposit will be the responsibility of the client after deduction of the security deposit. In the case of a security deposit in cash and if the client wishes to have the amount refunded immediately after departure, it is the client's responsibility to schedule an appointment no later than the day before departure to conduct an inspection of the accommodation.

6.5. Cancellation/Interruption Insurance

Cancellation and interruption of stay insurance are offered to the client as an optional service. 6.6. Optional Equipment

Nature et Océan offers optional equipment such as baby kits, sheets, towels, etc. These paid equipment are provided upon request and subject to availability.

ARTICLE 7. Right of Withdrawal



The Client is informed that, in accordance with Article L. 121-20-4 of the Consumer Code, the sale of accommodation services provided on a specific date or at a specified frequency is not subject to the provisions regarding the withdrawal period applicable to distance selling. Therefore, no right of withdrawal applies to the stays sold by Nature et Océan. However, this exemption does not apply to any insurance policies taken out (14-day period in accordance with and within the framework of legal provisions).

ARTICLE 8. Modification of Reservation / Stay



Any request for modification must be made at least 15 days before the start of the stay. It is the responsibility of the Client to request this from Nature et Océan by registered mail with acknowledgment of receipt to the address of the Village or by sending an email to the following address: [email protected]. Nature et Océan will endeavor to accommodate the request subject to availability and applicable rates. If the modification is not possible or accepted, the Client must either proceed with the stay under the initially agreed conditions or cancel it.

ARTICLE 9. Cancellation of Stay

9.1 Cancellation by Nature et Océan Management

Unless in cases of force majeure, the stay will be fully refunded. This cancellation cannot, under any circumstances, lead to the payment of damages.

9.2 Total or Partial Cancellation by the Client

It is the responsibility of the Client to notify the Village by registered mail with acknowledgment of receipt to the address of the Village or by sending an email with acknowledgment of receipt to the following address: [email protected].
The date of receipt of the cancellation will determine any cancellation fees.
In the absence of any written communication under the aforementioned conditions, the Client will be liable for the payment of all sums due under the reservation.

Depending on the cancellation date and the type of stay, cancellation fees will be retained according to the following scale:

> Accommodations other than the "Villa Coloniale":

  • 2 months or more before the start of the stay: no fees, full refund of amounts paid;
  • between 2 and 1 month before the start of the stay: 30% of the total amount will be retained;
  • between 1 month and 15 days before the start of the stay: 50% of the total amount;
  • less than 15 days before the start of the stay, or in case of no-show on the arrival date: 100% of the total amount;

> For the "Villa Coloniale"

  • 4 months or more before the start of the stay, a flat-rate indemnity of €150 will be retained;
  • between 4 and 1 month before the start of the stay, 30% of the total amount will be retained;
  • between 1 month and 15 days before the start of the stay, 50% of the total amount;
  • less than 15 days before the start of the stay or in case of no-show on the arrival date, 100% of the total amount.

Any stay commenced is due in full.

It is expressly stated that regardless of the chosen cancellation date, any fees for subscription to cancellation/interruption insurance are non-refundable.

In all cases:

ARTICLE 10. Course of the Stay



10.1 Arrival and Departure Times
Accommodations are available from 3:00 pm and must be vacated on the day of departure before 10:00 am at the latest.

In the event that a Client is unable to respect the arrival times, it is their responsibility to immediately contact Reception to try to find a solution. In case of no-show within 24 hours following the scheduled arrival date and without a written communication addressed to Nature et Océan confirming a certain date, the Village reserves the right to put the accommodation up for sale.

No refund or compensation will be made. No reduction will be made in case of delayed arrival or early departure.
In case of delay in handing over the keys / vacating the site, the "late check-out" option will be charged for each hour of delay started.

10.2 Length of Stay
The minimum length of stay may vary depending on the type of accommodation and the period of stay.

10.3 Check-in / Check-out
Check-in - Upon arrival, Reception checks the client's balance. The Client must have paid the full balance, present an official and valid identity document, and deposit the security deposit under the conditions set above. After registering the Client's arrival, Reception will hand over the keys to the rental accommodation and provide regulatory information to the Client. It is the Client's responsibility to check the inventory upon arrival and to report any non-compliance on the day of arrival.

Check-out - It is the Client's responsibility to return the accommodation in perfect cleanliness condition before 10:00 am. Otherwise, cleaning fees corresponding to the amount of the cleaning package could be withheld. Similarly, any broken, lost, or damaged items during the stay may be billed to the Client. The security deposit will be refunded under the conditions set above.

10.6 Pets
Two domestic animals are allowed per rental accommodation or pitch provided they are reported when booking or upon arrival on site. Domestic animals must not roam freely and must be kept on a leash, including on the rented pitch.

They are not allowed in the aquatic area and children's playground.
Animal waste must be picked up by the Client, and their behavior must not disturb the tranquility of other clients. Clients are asked not to leave their dog alone.

The acceptance of animals is subject to two conditions:

  • up-to-date rabies vaccination
  • identification by tattoo or chip attested by a card issued by the Société Centrale Canine. The client must provide the animal's health record.

Dangerous or aggressive animals (including dogs of the 1st and 2nd category) as well as exotic animals are not accepted.

ARTICLE 11. Complaint



Any complaint must be reported by the Client during their stay at the Village so that the latter can remedy the non-compliance or record it. If the non-compliance could not be resolved on-site, the Client may submit a written complaint to the Village Management so that it may attempt to remedy it. In order to best study the complaint, the Client is requested to provide as soon as possible all factual elements (photographs, videos, etc.) that he/she can gather unless the non-compliance has been noted on-site by the Village. Any complaint regarding the Client's stay must be addressed by him/her by mail to the Village address or by email to [email protected]. No complaint shall be considered for an incident that has not been reported to the Village Manager during the stay.

ARTICLE 12. Protection of Personal Data



While browsing our websites, information is collected about our Clients.

There are 3 categories of information:

Those that the Client communicates to us during a reservation request: names, first names, and dates of birth of all participants, postal address, email address, phone number.

Those that we collect automatically: cookies (see cookie usage policy).

Those that we collect from third parties.

All of this information is considered confidential by the Company. It is used only by Nature et Océan for processing the Client's request and to enhance and personalize communication and service offerings reserved for Clients.

ARTICLE 13. Image Rights Authorization



During their stay, the Client as well as the persons accommodated with him/her (hereinafter referred to as the "Accommodated Persons") may be photographed or filmed within the Village as part of group shots (hereinafter referred to as the "Images"), which the Client accepts on his/her behalf and on behalf of the Accommodated Persons. The Client also authorizes, on his/her behalf and on behalf of the Accommodated Persons, Nature et Océan to distribute the Images on their social networks for a maximum period of 5 years from the acceptance of these General Terms and Conditions of Sale.
In any event, it is understood that the Client and the Accommodated Persons:

  • may revoke the above authorizations by indicating, in writing, to the Village reception during their stay;
  • after the publication of the Images concerning them on social networks, may request their removal by sending an email to the following address: [email protected]
  • will not receive any compensation for the dissemination of the Images as provided for in this article 13.

ARTICLE 14. Applicable Law, Jurisdiction, and Mediation



These General Terms and Conditions of Sale are subject to French law, and any dispute relating to their application falls within the jurisdiction of the Courts of Dax, regardless of the Client's country of origin. In case of complaint and after contacting the Village Management in accordance with the Complaint procedure, the Client has the possibility to refer the matter to a consumer mediator, within a maximum period of one year from the date of the written complaint, by registered letter with acknowledgment of receipt, to the operator. In accordance with the provisions of Article 1368 of the Civil Code, it is expressly agreed that the data retained in the information system of the Company and/or its partners shall be binding. Thus, data stored on computer or electronic media, if produced as evidence by the Company in any contentious or other procedure, shall be admissible, valid, and enforceable between the parties.

ARTICLE 15. Partial Non-Validation of the General Terms and Conditions of Sale



In the event that any provision of these General Terms and Conditions of Sale is declared null and void due to a change in legislation, regulation, or a court decision, this shall in no way affect the validity and compliance of these General Terms and Conditions of Sale.
